1.1 The website www.jasgold.it (hereinafter, the Site) is owned and managed by Jas Gold srl (hereinafter also referred to as the Seller) with headquarters in via Rossini 17, 21057 Olgiate Olona (VA) with VAT number: 03834020129 and REA VA – 382420.

1.2 Through the Site, consumer users (hereinafter "Customers") can purchase, remotely and via the internet, the goods (hereinafter "Products") made available by the Seller on the Site itself.

1.3 These General Conditions of Sale apply to all sales of Products made remotely via the Site by the Seller to Customers who can be classified as consumers, pursuant to Legislative Decree 206/2005 (“Consumer Code”).
The Customer is required to read these Conditions carefully before proceeding with the purchase. Placing an order implies full acceptance of these General Conditions of Sale and the specific characteristics indicated in the product sheet.

1.4 The Seller reserves the right to modify or supplement these General Conditions of Sale at any time. The modifications will be effective upon their publication on the Site and will apply only to orders placed after that date. For each purchase, the Conditions of Sale in force at the time the Customer places the order will apply.

1.5 This contract is governed by Italian law. Any dispute arising from the interpretation, execution, or termination of this contract shall be subject to the exclusive jurisdiction of the Court of Milan.

2.1 Jas Gold sells handcrafted items using artisanal processes.

2.2 Jas Gold has a limited inventory (available in the “Ready for Delivery” section of the Website); therefore, all custom-made jewelry is produced exclusively to order.
Production times vary approximately from 2 to 4 weeks from order confirmation, depending on the complexity of the requested item.
Any customization requests (such as measurements, engravings, structural modifications, etc.) must be communicated before placing the order, to verify their technical feasibility.

2.3 As this is a handcrafted product, the purchased Products may present small, non-substantial differences compared to the original models photographically represented on the Site, including, but not limited to, the colour and size of the stones, the welding details, the position of the engravings and other details.

2.4 The price of the Products, expressed in euros, is the one indicated on the website www.jasgold.it at the time of ordering. For shipments within the European Union, the price includes 22% VAT.
For shipments to non-EU countries, VAT does not apply and any local taxes, duties, or customs fees remain the responsibility of the Customer.

2.5 The Seller reserves the right to change the prices of the products listed on the website at any time. The price of the Product charged to the Customer will be the one indicated in the order summary, viewed by the Customer before completing the order. Any changes (increases or decreases) subsequent to the order being placed will not be taken into account.

2.6 If the ordered Products are to be delivered outside of Italy, the total price indicated in the order is calculated net of customs duties, taxes, and local fees, which are the sole responsibility of the Customer. Since these costs are not known in advance, the Customer is advised to check with the relevant authorities of the destination country before placing the order.
The Customer declares to be aware that lack of knowledge of such costs cannot be invoked as a reason for withdrawal or termination of the contract and that he cannot in any way charge the Seller for the burden of such expenses.

3.1 Each shipment contains the product(s) ordered, as well as any informational and marketing materials. An invoice will only be sent if expressly requested by the Customer before completing the order.

3.2 The products ordered will be delivered to the address indicated by the customer when placing the purchase order via courier or postal parcel.

3.3 Upon receiving the goods at their home, the Customer is required to verify the integrity of the packages upon delivery by the courier. In the event of anomalies (missing items, damage to purchased items or the package), the Customer must have the courier accurately note and record these anomalies and, if necessary, refuse the delivery. Otherwise, the Customer will forfeit their right to assert their rights in this regard.
Furthermore, the Customer must notify the Seller of the incident at the email address info@jasgold.it within 7 (seven) days of delivery of the Products to the indicated shipping address.

3.4 From confirmation of payment, processing times are: 1 to 4 weeks for jewelry, 1 to 3 business days for shipping. Upon shipment of the Products, the Customer will receive confirmation via email or telephone message confirming shipment and will be provided with a tracking number to track the shipment. Since Jas Gold does not directly manage product deliveries, delivery times are indicative and cannot be considered binding. Jas Gold cannot be held liable in any way for failure to comply with these times.

3.5 Shipping costs are calculated at checkout, based on the type of products purchased, the selected delivery method, and the order's destination. Some items (such as jewelry) qualify for free standard shipping within Italy, while other products (such as accessories or small items) may also incur shipping costs for domestic orders.
An insured shipping option (optional) is also available, selectable at checkout, for an additional cost shown on the order summary page.
For shipments to foreign countries, Jas Gold reserves the right to apply a contribution to shipping costs, which is also calculated automatically before confirming the order.

4.1 The Customer can make payment using the methods indicated on the Site, such as credit card, PayPal, bank transfer or other electronic payment systems.

4.2 Payment must be made in advance, and the contract will be deemed concluded only after the Seller has received the payment. The order will be prepared and shipped only after payment has been received.

4.3 For orders paid by bank transfer, the Customer is required to make the payment within 5 (five) days of the order date and send a copy of the payment receipt to the email address info@jasgold.it . If the payment and the related receipt are not received within this period, the order will be automatically cancelled without further notice, unless otherwise agreed in writing between the Customer and Jas Gold.

4.4 Jas Gold assumes no responsibility for any delays or malfunctions in transactions resulting from intermediaries or payment managers.

4.5 Any fees applied by payment providers are the responsibility of the Customer and are non-refundable.

5.1 The risk of loss or damage to the products, for reasons not attributable to the seller, is transferred to the customer only when the customer, or a third party designated by the customer and other than the carrier, physically takes possession of the products.

5.2 The seller is not responsible for any disruptions, delays, or omissions in deliveries attributable to force majeure or unforeseeable circumstances. Likewise, the seller is not liable in the event of exceptional events such as fires, explosions, strikes, natural disasters, wars, riots, demonstrations, or other similar events that prevent the execution of the contract according to the timeframes and methods established by these General Conditions of Sale and applicable law.

5.3 It is understood that, except in cases of willful misconduct or gross negligence, the Seller – if responsible – is liable only for direct and foreseeable damages at the time of conclusion of the sales contract and is not liable for any losses suffered, lost profits or any other damages that are not an immediate and direct consequence of the breach or that were not foreseeable at the time of conclusion of the sales contract.

6.1 All Jas Gold jewelry listed in the "custom jewelry" section or made from scratch to order and customized are produced exclusively at the time of order and according to the specifications indicated by the Customer. Pursuant to art. 59, paragraph 1, letter c), of the Consumer Code (Legislative Decree 206/2005), the right of withdrawal is excluded for these custom-made or clearly personalized goods, and therefore cannot be exercised.
For products purchased in the "ready for delivery" section of the site, which are not personalized or made to measure, the Customer has the right to withdraw within 14 days of receiving the product, pursuant to current legislation, provided that the product is returned intact and unmodified.
The right of withdrawal automatically lapses if the ready-to-deliver product is modified, for example by changing the size or customizing it, making it impossible to resell it as new.

6.2 The right of withdrawal within 7 days of receiving the goods may be exercised only in the event of defects or obvious structural problems that prevent proper use. Irregularities, irregularities, or slight differences from the images do not constitute defects, as these are characteristics of artisanal and hand-crafted products. The legal guarantee of conformity remains valid in any case pursuant to Articles 128 et seq. of Legislative Decree 206/2005.

6.3 The Customer has the option to cancel the order placed within and no later than 24 (twenty-four) hours of confirmation of the same, exclusively on condition that:
• for custom-made or personalized jewelry, production has not already started;
• for ready-to-deliver jewelry, the order has not already been shipped.
The cancellation request must be sent promptly by email to info@jasgold.it , indicating the order number and the reason for cancellation.
In the event of a valid cancellation that complies with the above requirements, Jas Gold will refund the amount paid, net of any fees retained by payment processors (e.g., PayPal, Stripe, etc.), which are automatically collected at the time of the transaction and are not refundable, even by the seller.
After 24 hours, or if the order has already been started or shipped, it will no longer be possible to cancel the order, and the conditions set out in the following points regarding withdrawals and changes will apply.

6.4 Any errors in the communication of ring sizes, phrases to be engraved, or other specific customizations provided by the Customer do not constitute manufacturing defects, but rather incorrect information provided at the time of ordering. Changes requested to correct such errors are possible, but the related costs (processing and shipping) will be borne by the Customer and communicated in advance by Jas Gold.

6.5 In the event of incorrect sizing or requests for alterations to a purchased piece of jewelry, the Customer can contact Jas Gold by email at info@jasgold.it , specifying the reason for the request and the desired alterations. Shipping and processing costs will be borne entirely by the Customer and communicated in advance. Resizing a ring is free of charge only once, if requested within 30 days of receiving the product. For subsequent alterations or alterations to other jewelry, costs will be calculated on a case-by-case basis.

6.6 To exercise the right of withdrawal, the customer must inform the seller of his decision explicitly and in writing via an email sent to info@jasgold.it within the above-mentioned period of 7 working days, indicating:
• the expression of the will to exercise the right of withdrawal
• the reference order number
• the jewel you want to return
The request must be motivated in accordance with Article 6.2.

6.7 The customer undertakes to return the products within 10 working days from the date of the withdrawal notification. All costs associated with returning the products are entirely borne by the customer. Failure to return the goods within the established timeframe will, in any case, result in the forfeiture of the right of withdrawal. Customs duties, shipping costs, sales taxes, and fees withheld by payment processors (e.g., PayPal, Stripe, etc.) are not refundable under any circumstances, even in the event of withdrawal or return of the product.
The seller may withhold the refund until the customer has demonstrated that the goods have been returned. If customers exercise their right of withdrawal in a manner that does not comply with the procedures and terms set forth in this article, they will not be entitled to a refund.

6.8 The seller undertakes to refund the amount due as quickly as possible and, in any case, within 30 days from the date of receipt of the returned goods, provided that:
• the products have actually been returned;
• the products are intact and have not been used;
• the packaging and original wrapping are returned intact;
• any included accessories are present and intact.
The refund will be made only after verifying the integrity of the product, the original packaging, and any accessories included.
In the event of missing, damaged or evident use of one or more non-essential elements (such as the original packaging, certificates, sachets or other accessories), Jas Gold reserves the right to:
• refuse the refund, or
• apply a proportional withholding on the amount to be refunded, in relation to the decrease in value of the returned goods, pursuant to art. 57 of the Consumer Code.
The seller also reserves the right to withhold the refund until the goods are received or until the customer has provided proof of shipment, pursuant to art. 56 of the Consumer Code.

6.9 The refund to the customer will be made using the same payment method used by the customer for the initial transaction, unless the customer has agreed otherwise.

7.1 The seller guarantees customer support before and after the sale via the email address ciao@jasgold.it or through the official Jas Gold channels.

7.2 For any complaints or disputes, you can use the European Online Dispute Resolution (ODR) platform ec.europa.eu/consumers/odr (Article 14 of Regulation (EU) No. 524/2013 ).

8.1 All intellectual property rights relating to the online store, including text, images, graphics, trademarks, and other content, are the exclusive property of Jas Gold. Reproduction, in whole or in part, modification, distribution, transmission, or any other use of the online store's content, by electronic or traditional means, is prohibited without the prior written consent of Jas Gold.

9.1 Should one or more provisions of these General Conditions of Sale be invalid, ineffective or unenforceable, this shall not affect the validity, effectiveness and enforceability of the remaining provisions, which shall continue to remain fully valid and effective.

9.2 The parties undertake to replace invalid or ineffective clauses with valid provisions that, in content and purpose, come as close as possible to the original ones.
